Supreme Court Halts Key Transgender Protections in Biden's Title IX Overhaul
The Supreme Court, in a significant ruling on Friday, declined to allow the Biden administration to enforce critical portions of a new Title IX rule aimed at protecting transgender students from discrimination.
This decision leaves intact rulings from federal courts in Kentucky and Louisiana, which blocked the Department of Education from implementing the rule across 10 states while legal battles continue.
The court’s refusal to intervene in means that key components of the Biden administration’s April 2024 Title IX rule, which redefines “sex discrimination” to include gender identity, will remain on hold.
This decision affects how schools across the country can implement policies related to transgender students, particularly concerning access to restrooms and locker rooms that align with their gender identity.
Four of the nine justices indicated support for allowing some of the rule’s provisions to take effect.
However, the court unanimously agreed that the most controversial elements, such as the redefinition of sex discrimination and restrictions on same-sex spaces, should remain blocked.
The Biden administration’s efforts to expand Title IX’s protections to LGBTQ students have faced intense opposition from several states.
Two separate cases brought by coalitions of Republican-led states challenged the rule’s provisions.
One case involved Louisiana, Mississippi, Montana, and Idaho, along with the Louisiana Department of Education, while the other was filed by Tennessee, Kentucky, Ohio, Indiana, Virginia, and West Virginia.
In June, federal district courts in Kentucky and Louisiana sided with the states, issuing preliminary injunctions that blocked the enforcement of the entire rule in the 10 states involved in the lawsuits.
The Biden administration sought emergency relief from the Supreme Court, arguing that the lower courts’ rulings were overly broad and prevented the implementation of unchallenged provisions of the rule.
However, the Supreme Court found that the challenged provisions were too intertwined with the rest of the rule to allow partial enforcement.
Justice Sonia Sotomayor, joined by Justices Elena Kagan, Ketanji Brown Jackson, and Neil Gorsuch, expressed strong dissent, arguing that the lower courts had overstepped their authority by blocking unchallenged portions of the rule.
Sotomayor emphasized that these provisions, which included protections for new mothers and pregnant students, were unrelated to gender identity and should not have been included in the injunction.
“The injunctions this Court leaves in place will burden the Government more than necessary,” Sotomayor wrote, warning that the decision would needlessly impair the enforcement of Title IX and deprive students of critical protections against sex discrimination.
The Biden administration’s Title IX rule is part of a broader effort to protect the rights of transgender students amid a wave of legislation in Republican-led states targeting transgender youth.
Over 20 states have enacted laws restricting treatments such as puberty blockers and hormone therapy for minors with gender dysphoria, and at least 11 states have passed laws barring transgender individuals from using bathrooms that align with their gender identity.
As legal challenges to these state laws continue, the constitutionality of Tennessee’s ban on gender-affirming care for minors is set to be reviewed by the Supreme Court this fall.
This upcoming case, along with the ongoing disputes over Title IX, highlights the intensifying legal battles over transgender rights in the United States.
