Alec Baldwin’s Involuntary 2021 ‘Rust’ Manslaughter Trial Ends Abruptly — Here’s Why


In a surprising turn of events, Alec Baldwin’s involuntary manslaughter trial came to an abrupt end when a New Mexico judge dismissed the case with prejudice.

The trial, which began just two days prior, was related to the tragic October 2021 shooting on the set of the movie “Rust” that resulted in the death of cinematographer Halyna Hutchins.

The dismissal left Baldwin visibly emotional, marking a significant legal victory for the actor after nearly three years of intense legal battles.

The Emotional Verdict for Baldwin

Judge Mary Marlowe Sommer’s words, “Your motion to dismiss with prejudice is granted,” were met with a visibly emotional Baldwin.

The actor, who had been under immense pressure, was seen removing his glasses and sobbing into his hand before embracing his wife, Hilaria.

This ruling means that Baldwin will no longer face the possibility of 18 months in prison and a $5,000 fine that were hanging over him.

The Incident

The incident occurred on 21 October 2021, when Baldwin was practicing a “cross draw” with a prop gun on the set of “Rust.”

The gun fired a live round, tragically killing Hutchins and injuring the film’s director, Joel Souza.

The unexpected presence of live ammunition on set sparked widespread outrage and led to a series of legal proceedings.

Defense’s Motion to Dismiss

Baldwin’s defense team filed a motion to dismiss the case, arguing that the prosecutors had concealed crucial evidence.

According to court documents, the defense alleged that evidence potentially pointing to an external source of the live ammunition, specifically prop supplier Seth Kenney, was not shared with them.

This accusation of evidence suppression became a pivotal point in the case.

Courtroom Chaos

The courtroom on Friday saw a chaotic scene with one special prosecutor taking the stand as a witness and another, Erlinda Johnson, resigning from the prosecution team.

Despite the disorder, Judge Marlowe Sommer sided with the defense, citing the evidence suppression issue raised on Thursday.

Her decision to grant the motion to dismiss with prejudice ensures that the case cannot be reopened in the future.

Reactions from the Prosecution

Special prosecutor Kari Morrissey expressed disappointment with the dismissal, stating, “I believe that the importance of the evidence was misconstrued by the defense attorneys, but I have to respect the court’s decision.”

Key Elements of the Dismissal

Judge Marlowe Sommer emphasized the severity of a dismissal with prejudice, calling it a “very extreme sanction.”

The defense argued that state investigators failed to properly disclose a box of ammunition connected to the case, which could have been favorable to Baldwin.

The judge found that the suppression of this evidence satisfied the requirements of a Brady violation. She noted that the late discovery of the evidence impeded the defense’s ability to use it effectively, impacting the fairness of the trial. The suppressed evidence was deemed both favorable and material to Baldwin’s case.

Implications for the Judicial System

Marlowe Sommer criticized the state’s conduct, describing it as “intentional and deliberate” and close to bad faith. She highlighted the prejudicial impact on Baldwin’s case, stating that the late disclosure undermined the defendant’s preparation for trial. The judge concluded that dismissal with prejudice was necessary to maintain the integrity of the judicial system and ensure justice was administered efficiently.

Future of the Case

Following the dismissal, the attorney for Hannah Gutierrez-Reed, the armorer on the set of “Rust,” announced plans to seek dismissal of her case as well.

Jason Bowles, Gutierrez-Reed’s attorney, echoed the concerns raised in Baldwin’s case, pointing to similar failures by the state.
